As of 10 June 2025, there have been amendments to the Family Law Act 1975, in regard to what constitutes family violence and how it is considered in property settlements.
These amendments greatly assist victims of family violence, as the economic impacts of financial abuse can be significant, and these amendments aim to alleviate these impacts.
Financial and economic abuse are now defined in the Act as family violence, and will be taken into account in the same way as other forms of family violence.
Financial abuse, such as one party not allowing the other to have a job, will now be considered in a property settlement. These considerations are important as they show why one party may not have been able to contribute to the joint asset pool in any significant way, while one has done so significantly.
The current and future impacts of family violence may also be considered during property settlements, such as the cost of ongoing counselling services or other necessary support.
